    Dear President;

    Consider the following summation of the worst experience in my 40 years with acquiring a new cell phone, of which is necessary for my livelihood.

    Recollection of events:

    1. March 12, 2022 – ordered via Best Buy Canada website: a Samsung Galaxy Note 10+, Black, UNLOCKED per web information, and an estimated 2 day delivery time, and paid on-line $663.17 cdn (order # 1005170696)
    2. March 15, 2022 – after no response regarding a confirmation of delivery, I contacted Best Buy via their on-line chat associate to inform them of the lack of response.
    3. – the Best Buy associate reached out to Gadget Source
    4. – Gadget Source emailed me stating they we out of stock in the black colour, but would I agree to an Auro Glow one, and I immediately replied yes, as long as it is received the next day.
    5. March 16, 2022 – UPS courier delivered the phone in the morning
    6. – I transferred all my data from my existing Note 9 phone to the new one, and began using the device.
    7. – A software update request automatically appeared on my phone, and I attempted to process the update.
    8. – The update froze the device, and a message stating that I needed to contact “Sprint” to have it unlocked.
    9. – I contacted my current phone provider, Rogers, and a tech informed me that the phone was locked, and it was a discontinued model that the warranty had run out at the end of December 2020.
    10. – again, a cell phone is necessary to sustain my livelihood, therefore I drove to the Best Buy store on Fairway Road, Kitchener, Ontario, Canada. After a duration of 2.5 hours with the manager, along with spending $1,864.83, I had a new functioning phone.
    11. To reiterate the importance of my phone, I had a high-end client mention to me that I did not respond to his texts earlier, due to the Note 10+ malfunctioning!

    Before retaining legal council, I wanted to allow you the opportunity to provide damages in the amount of $1,201.66 (new phone less phone returned $1,864.83 – $663.17), which does not include my time to wait for the new phone to be operational, (approximately 2.5 hours), nor the time to return the fraudulent phone (1 hr).

    Your response is necessary on or before April 10, 2022.
